Taylor Swift faces jury trial in DJ assault case

A judge has thrown out a former radio personality's slander claim against Taylor Swift in an ongoing lawsuit that centers around a groping incident that allegedly took place in 2013. The Colorado federal judge partially rejected Swift's countersuit, and now both accounts must be heard by a jury at a nine-day trial beginning August 7 to determine whether Swift and her team intentionally got Mueller fired from the radio station.

Last February, Mueller filed an amended complaint that added two slander claims to his original suit, in which he claimed Swift's statements stating he sexually assaulted her are false and have harmed his reputation. She said that during the grope, Mueller had lifted up her skirt. A judge ruled that the photo will remain sealed, but Swift's deposition was released.

"Ms. Swift knows exactly who committed the assault - it was Mueller - and she is not confused in the slightest about whether her long-term business acquaintance, Mr. Haskell, was the culprit", stated Swift's countersuit.

"Second, treating Mueller's testimony as true, a jury that found he was wrongly accused might, as a outcome, also conclude that Defendants acted with reckless disregard for the veracity of their accusations, or based on a grossly inadequate investigation", writes the judge. Swift argued that it was KYGO's independent investigation that triggered the firing, but Martinez says when viewing the evidence most favorably to Mueller, "the record does not reflect a truly independent investigation", and that under Colorado law, proximate cause needn't be a prerequisite to liability for intentional interference with contract.

Mueller, who originally sued the star for loss of wages, has always maintained Swift was groped by another worker at the station. The statute of limitations for such allegations is just one year from the incident in question. Swift has promised to donate any money she's awarded as a result of the trial to charities for victims of sexual assault.

Today, a Judge partially rejected Swift's motion for summary judgment, which means the case will receive a jury trial, according to The Hollywood Reporter.
