"The right to reside and settle in the country is available only to citizens and not to illegal immigrants", said the Indian government as the Supreme Court is set to hear a petition against Rohingya deportations on 3 October.

India has sent 53 tonnes of relief materials to Bangladesh for Rohingya Muslim refugees from Myanmar, who poured into this country following the ethnic violence in the neighboring Buddhist-majority nation.

"The Rohingyas are not refugees".

The bench, meanwhile, did not issue notice to the National Human Rights Commission (NHRC), which is already seized of the matter and has recently issued notice to the Central government.

The external affairs ministry then recognised that those fleeing Rakhine State are refugees - though the home ministry believes they no longer deserve that designation once they are in India. The case is being heard as Bangladesh struggles with more than 410,000 Rohingya who have flooded across the border since August 25 when the military in Buddhist-dominated Myanmar launched a crackdown on the minority Muslim group.

He said India would not be violating any global law by acting against illegal immigrants as the issue was related to India's national security.

The Centre has also said that even Rohingya's registered with the United Nations High Commission for Refugees would be deported.

The Home Minister told the seminar that by deporting the Rohingyas, India would not be violating any global law.

While talking to media ahead of SC's hearing, Union Minister Kiren Rijiju criticised the human rights groups by asking them not to spread "misinformation about India" regarding the issue of Rohingya refugees in the country.

Since India is not a signatory to the global pact on refugees, it is not forbidden from returning asylum seekers to a country in which they are likely to face persecution. In the past four weeks, over 420,000 Rohingya have fled to Bangladesh, and satellite imagery and heat sensors analysed by Human Rights Watch have shown more than 228 villages burned to the ground in northern Rakhine state.

He insists, "Most of the 40,000 Rohingyas came to India from Bangladesh".

"Any sovereign country is independent to take action against illegal immigrants".

Earlier this week, Myanmar's de facto leader Aung San Suu Kyi has offered to take back those Rohingyas who wished to be back in Myanmar, but only after detailed verification.
