Trump slammed for calling to deport migrants without due process

Seventeen states sued the Trump administration on Tuesday over its now-halted practice of separating migrant families that illegally cross the US-Mexico border.

The Border Patrol has stopped referring illegal immigrant parents for prosecution, a top official confirmed Monday, and the White House said it no longer has the resources to hold people in the detention system, signaling the latest hiccups in President Trump's zero tolerance border policy.

Calling the policy "an affront" to the states' interests in maintaining standards of care for children and preserving parent-child relationships, the lawsuit said: "The policy, and the administration's related conduct, has caused severe and immediate harm to the states and their residents".

A mother from Guatemala wiped tears from her eyes Monday as she told reporters in El Paso, Texas, about her 4-year-old son being taken away after they crossed the border.

Later, protesters gathered outside the hotel where Sessions was scheduled to speak.

The agency is now taking an average of 57 days to place children in its care with adult sponsors. Congress has struggled mightily with immigration legislation, most recently this week when a comprehensive "compromise" bill went down to defeat in the House.

The order responds to a class-action lawsuit by the American Civil Liberties Union (ACLU) on behalf of families separated at the US-Mexico border, including those who presented themselves a ports of entry.

Trump has not visited any of the facilities where the children have been detained, and has not publicly announced plans to do so.

Sen. Richard Blumenthal of CT was among those who toured a shelter at the Tornillo border crossing in West Texas.

The Trump administration has faced increasing criticism over what advisers have claimed is a conscious decision to take minors away from undocumented immigrant parents and guardians. Many migrants lack the proper documentation and it'll be a huge undertaking filled with background checks and verification processes to reunite a lot of these kids with their parents.

"I think there is very, very powerful consensus on both sides of the aisle that reunification should be done immediately", Blumenthal said. He said the move was in response to Trump's June 20 order and that his agency was working on a plan to resume criminal referrals.

The temporary shelter at Tornillo was close to its 360-person capacity.

He told the audience that lax border enforcement would "encourage more adults to bring more children illegally".

U.S. media earlier reported that one of the bases would be used to house migrant families and the other would shelter undocumented children who enter the United States unaccompanied by an adult.

"Neither the order nor the administration's Flores application offers any assurance that the Administration will not return to a family separation policy when its efforts to intern families together fail", the states said in their suit.

In a tweet, he wrote "Hiring manythousands (sic) of judges, and going through a long and complicated legal process, is not the way to go - will always be disfunctional (sic)", he said.

Asked about the age of children in HHS custody, Azar said, "We have infants in our care". Confusion reigned, with officials later telling reporters on a conference call they couldn't provide complete numbers because they are focused on reuniting families.

But Mr Trump had suggested the families would instead be detained together.
