The expansion would have tripled capacity of the existing Trans Mountain pipeline, allowing it to ship up to 890,000 barrels of bitumen oil every day from Alberta's tar sands to a terminal in Vancouver, British Columbia.

Kinder Morgan shareholders voted overwhelmingly, 99 percent, to approve the $4.5 billion Canadian (U.S. $3.4 billion) sale of the pipeline to the government shortly after the court decision was announced.

Horgan stopped short of saying the project is dead, but he said his government will now focus on other issues, such as housing and jobs.

The 2018 provincial budget forecasted a debt load that would balloon to $96 billion by 2023 from $54 billion this year. "The court has stepped in where Canada has failed to protect and respect our rights and our water".

Under the Constitution, Canada has a "duty to consult" and accommodate Indigenous people when a project may impact their Aboriginal or treaty rights. "We as groups can offer up the proper consultation and offer up the proper management of the overall project as it goes forward".

Jason Kenney, leader of the official opposition United Conservative Party, said the court ruling "undermines national unity" and "is creating massive investor uncertainty".

December 16, 2013: An application is made to the National Energy Board (NEB) to expand the Trans Mountain pipeline.

Members of the Indigenous groups that challenged the project gathered on the shore of the Burrard Inlet in Vancouver to celebrate their victory.

"We will analyze this decision and respond promptly", he said.

Morneau said the government remains committed to the project.

"The unjustified exclusion of marine shipping from the scope of the project led to successive, unacceptable deficiencies in the board's report and recommendations", Dawson wrote, noting that the Governor in Council "could not rely on the board's report and recommendations when assessing the project's environmental effects and the overall public interest".

Prime Minister Justin Trudeau has hailed the expansion as a key to reducing Canada's reliance on USA oil and boosting exports to Asia, and said it would create up to 15,000 jobs. They were supported by the province of British Columbia, which was an intervener, as was Alberta.

"I was expecting a more mixed ruling", said Gene McGuckin of Burnaby Residents Against Kinder Morgan Expansion.

"This is a major victory for my community", said Coldwater Indian Band Chief Lee Spahan.

January 30, 2018: B.C. government moves to restrict any increase in diluted bitumen shipments until it conducts more spill response studies, a move that increases the uncertainty for Trans Mountain.
