CNN seeks hearing after White House again vows to yank reporter's access

CBS' White House Correspondent There's a Level of Decorum Expected of White House Press Pool

President Donald Trump watches as a White House aide reaches to take away a microphone from CNN journalist Jim Acosta during a news conference in the East Room of the White House in Washington.

(He extended the timeline to 6 p.m. after a request by the DOJ.) The White House tried to solve the due process problem identified by Kelly in Friday's ruling by sending Acosta a new letter notifying him why his pass was revoked. "We look forward to continuing to cover the White House".

Kelly - who was appointed by President Donald Trump - granted a temporary restraining order in CNN's favor Friday, forcing the Trump administration to reinstate Acosta's credentials while CNN's full legal challenge continued. You can't give notice after taking official action, though; due process typically requires giving the person being targeted a chance to make his case before the government acts. It's signed by Bill Shine, deputy chief of staff for communications, and Sarah Sanders, White House press secretary, who are both named as defendants in the initial lawsuit.

Ultimately, Trump seems to view his feud with CNN as good politics, as his 2020 re-election campaign used the revocation of Acosta's press pass as fundraising fodder.

Follow-up questions, the White House adds in a letter to Mr Acosta, will only be allowed "at the discretion of the president or other White House officials".

But the new letter from Shine and Sanders is an "attempt to provide retroactive due process", the lawyers said. On Friday, Trump said that "rules and regulations" were being drafted to govern news conferences, where the president or his representatives often accuse journalists - Acosta in particular - of being overly hostile.

The letter cites "behavior" at a press conference the day after the midterms that "violated the basic standards governing such events" as the reason to suspend Acosta's pass.

Dan Gainor of Media Research Center says Acosta is already getting on his colleagues' nerves - although publicly they all say they support his antics.

The drama between the White House and Jim Acosta isn't over yet.

If the White House were to seek again to pull the hard pass, it would have required the administration to first ask a federal judge to lift a court order. CNN filed new papers today accusing the Trump administration of violating their constitutional rights by planning to punish Acosta retroactively by applying rules of decorum that aren't written.

For his part, Trump has said the issue is "not a big deal."
