US says 8-year-old Guatemalan boy has died in custody

A CBP spokesman declined to elaborate Tuesday, but said details will be released shortly. Jakelin Caal Maquin and her father, Nery Caal, were apprehended by Border Patrol agents in the New Mexico desert on December 6, as part of a larger group of 163 illegal aliens.

Her death marked another flashpoint in the debate over the White House's hard-line approach to immigration enforcement, with many - including Jakelin's family - wondering if better medical care may have saved her.

The consul identified the father as 47-year-old Agustin Gomez, and said he remains in US Border Patrol custody. He died hours later, the CBP said.

Felipe González Morales, the United Nations special rapporteur on the human rights of migrants, said Monday that American authorities "must ensure that an in-depth, independent investigation" is conducted.

Democratic members of Congress and immigration advocates sharply criticized CBP's handling of the death and questioned whether border agents could have prevented it by spotting symptoms of distress or calling for an evacuation by air ambulance sooner.

He also sought a congressional investigation into the death. While in the hospital, the girl was revived after going into cardiac arrest but she died less than 24 hours later.
